Version 1.0.3 · Dated 3 November 2026
1. Provider and scope
The provider is schukai ("we"). Postal address: Eichenstraße 26, 82290 Landsberied, Germany; email: hey@schukai.com. Full provider details are in the linked imprint. These terms govern your use of Sapeluno, in particular the Android app with the package name com.schukai.sapeluno. Purchase, payment, subscription management and refunds through Google Play are also subject to the Google Play terms. The Sapeluno privacy notice applies separately.
2. Offer and local use
Sapeluno is offered worldwide through Google Play where that distribution channel is available in the country concerned and enabled for the offering. You do not need an account for local use. Sapeluno contains no advertising. Your content is stored on your device; you are responsible for backups, for example using the app's export and backup function.
3. Licence
We grant you a simple, non-exclusive and non-transferable right to use Sapeluno for your personal use. Sapeluno may not be rented out, sold or passed on without authorisation, or used to circumvent purchase, subscription or access controls.
Statutory transfer rights, including exhaustion of distribution rights, remain unaffected. Lawful transfer of a program copy does not automatically transfer a separate account or an ongoing service contract.
4. Trial and full version
You can try the local Sapeluno features described in the relevant offer on Android for 30 usage days. Only days on which you create, change or practise something are counted. After that, creating and editing new content requires the one-time in-app purchase of the full version. Viewing, searching, exporting, backing up and restoring, and deleting your data always remain possible, even without a purchase.
The full version is a one-time, non-consumable in-app purchase through Google Play. It also works offline. You can restore the purchase on your own Android devices using the same Google account.
Scope of the purchase. The one-time purchase permanently unlocks the features described at the time of that purchase. Larger new features or feature packages may later be offered as separate, optional one-time purchases. Purchased features remain unlocked without another purchase and are not subsequently converted into a subscription. Ongoing services are offered separately unless already included in the promised purchase scope.
We provide statutorily required bug fixes and security updates without an additional purchase price. Other statutory duties, including updates necessary to maintain conformity with the contract, remain unaffected. We envisage adaptations to new versions of the supported operating systems and smaller improvements, without promising a particular development, release or deadline. Whether and when such voluntary updates appear may also depend on approval by the relevant store. This does not relieve us of statutory duties or promises already made.
This applies to both new and existing purchases. The services and any broader promises applicable at the original purchase remain binding, including expressly promised future features or updates. This version does not restrict those promises retrospectively or automatically replace existing contractual terms.
5. Sync
Sync is an optional subscription for syncing data between your devices. It requires the full version and transfers your data with end-to-end encryption.
Depending on the chosen offer, the initial term is six or twelve months. The price, billing period and taxes are displayed in Google Play before purchase.
The initial term displayed in the purchase offer ends at its expiry if cancelled in time; you may give ordinary notice at any time before then. Without cancellation, the subscription continues for an indefinite period after the initial term. You may then cancel at any time with no more than one month's notice. Shorter periods granted by the offer or law remain available. Annual billing does not create another fixed annual commitment.
You can manage and cancel the subscription in your Google Play account. You may also send necessary termination notices and other statutory declarations to hey@schukai.com. Your rights do not depend on whether the store interface offers a particular function. Sync access ends when termination takes effect; advance fees for periods after that date are refunded proportionately. Statutory withdrawal, refund and termination rights remain unaffected.
For consumers habitually resident in Austria, the following also applies: before the initial term moves into indefinite continuation without cancellation, we separately remind you at the start of a reasonable declaration period about continuation, its effects and the cancellation option. Without the required reminder, continuation based on silence does not take effect. Broader mandatory rights of your country of residence remain available.
After Sync ends, your purchased local Android features remain usable. Desktop editing requires an active Sync subscription as described in section 6.
6. Desktop editions for Windows and Linux
The desktop editions we offer for Windows and Linux can be downloaded free of charge. Creating and editing content there requires an active Sync subscription. The one-time purchase of the full version applies to Android. Reading, searching, exporting, backing up and restoring, and deleting remain possible in the desktop edition even without an active subscription.
7. Payment, withdrawal and refunds
Payment, receipts, subscription management and any refund procedure offered there are handled through Google Play. These terms do not restrict withdrawal, refund or statutory consumer rights.
8. Protection of the software
Sapeluno and its protected elements may not be copied, incorporated or adapted without authorisation. You may not reverse-engineer, decompile or disassemble the software or otherwise derive its source code unless the activity is permitted by law. Lawful activities, particularly under sections 69d and 69e of the German Copyright Act, remain permitted. Within the statutory limits, these include backup copies, observing, studying or testing the program and achieving interoperability.
You may not incorporate protected program code or protected parts of the documentation, user interface or file specifications without authorisation into replicas, substitutes or imitating products, or into competing or compatible software. This does not impose a general ban on independent development based on unprotected ideas, principles, functionality or formats. Lawful interoperability is not prohibited.
You may access, export, back up, share and reuse your own content and data, including with other programs. This does not promise additional technical export features or change third-party rights in that content. Statutory rights and any broader rights under applicable third-party or open-source licences remain unaffected.
9. Updates and changes
We provide statutorily required updates, including security updates, and notify you through Google Play or in the app. No additional fixed voluntary support or update period is agreed.
Valid reasons for changes to ongoing digital services are changed operating-system or store requirements, security risks, mandatory legal changes or the loss of irreplaceable third-party components.
Changes to an ongoing digital service beyond maintaining conformity are made only for one of the stated valid reasons and without additional cost. We provide clear information about the change. If access or use is adversely affected more than insignificantly, we give reasonable advance notice on a durable medium explaining the content, timing and your statutory rights. Where the statutory conditions are met, you may terminate free of charge within 30 days. The period starts on receipt of the information or, if later, when the change occurs. Statutory exceptions, including continued unchanged use at no additional cost, remain applicable. This does not authorise changes to agreed prices or withdrawal of purchased perpetual rights.
10. Warranty
Statutory remedies for defects apply. Statutory consumer rights for digital products remain unaffected.
11. Liability
schukai is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, within the scope of a guarantee given, and under the German Product Liability Act and other mandatory liability rules.
For a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract at the time it was concluded. Essential obligations are those whose fulfilment makes proper performance of the contract possible and on which you may regularly rely. Otherwise liability for slight negligence is excluded.
These limitations do not apply in the cases described in the first paragraph. This liability clause does not restrict statutory rights to cure defects, reduce the price or end the contract.
If you culpably contributed to the occurrence or extent of damage, that contribution is assessed under the applicable statutory rules. This also applies to omitted backups where making them fell within your responsibility and was possible and reasonable. Backup and recovery services owed by schukai remain unaffected.
The exclusions and limitations apply to the same extent in favour of schukai's legal representatives, employees and persons used to perform its obligations.
12. Law and new versions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where Article 120 of the Swiss Private International Law Act excludes a choice of law for a consumer contract, the law determined by that provision applies instead; the German choice of law does not apply to that extent. If you are a consumer, you keep the mandatory protection of the country where you habitually reside. For consumers, the statutory place of jurisdiction applies.
This version applies to contracts into which it has been effectively incorporated. A later publication does not automatically replace existing terms. Changes to ongoing contracts are made only through a legally permissible amendment procedure.
