1. Provider and scope
The provider of raus is schukai, Eichenstraße 26, 82290 Landsberied, Germany, email: hey@schukai.com. Full details of the contracting party are in the imprint.
These terms apply to the Android app with package ID com.schukai.raus once it is supplied through a distribution channel designated by schukai. These terms do not promise a store's current testing or publication status. The raus privacy policy applies separately.
2. Contract formation and minimum age
The use contract is formed when raus is obtained with these terms incorporated. The version described here includes no schukai account, subscription or in-app purchase.
raus is offered only to people aged 18 and over. The distribution channel's terms additionally apply to the store account, download and updates. Statutory claims against schukai remain unaffected.
3. Features
raus records typed notes, Android speech input, voice memos and scanned text. From these, the app can locally derive suggestions for tasks, appointments, follow-ups and email drafts. The exact scope depends on the app version, operating system, device and available system services.
The current version uses no schukai backend and does not synchronise work data between devices. Cloud AI, a schukai account, server-side recovery and guaranteed transcription on every device are outside the agreed scope.
4. Suggestions, review and external handoffs
Automatically recognised content is a suggestion. Speech input, transcription, text recognition and rule-based deductions may be incomplete or incorrect. Users review and edit a suggestion before adopting it or passing it to another application.
raus provides no legal, tax, medical, personnel or other professional advice. Appointments, deadlines, recipients, contact details and message text must be checked before use. The terms of the selected target application also apply to any deliberately opened calendar, email, sharing or file function.
5. Right of use
schukai grants the user a simple, non-exclusive, non-transferable right to use raus for their own private or professional notes within the intended functionality. Professional use does not make schukai the contracting party, adviser or person responsible for performing obligations to the user's clients.
The app must not be rented out, sold, passed on without authorisation, manipulated or used to circumvent technical protective measures. Activities permitted by law remain unaffected.
6. Local data, permissions and backups
Notes, work states, voice memos and exports are stored locally. Users decide whether to use microphone, camera, scanning, calendar, email, file and sharing functions. The operating system or configured system services may perform their own data processing.
Users are responsible for device protection, backups and exported files. Uninstalling, clearing app data, a defect or loss of the device may permanently remove content not backed up elsewhere. schukai cannot restore local content from a backend.
Content must not be recorded or shared if its processing is unlawful or infringes third-party rights. For audio recordings and scans, users must in particular check whether affected people need to be informed or consent is required.
7. Updates and changes
schukai provides updates, including security updates, required by law and gives information through the designated distribution channel. No additional fixed support or update period is agreed.
raus may be changed for a valid reason, for example to adapt to operating-system or store requirements, security needs, mandatory law or system services that are no longer available. Statutory information and termination rights apply to continuously supplied digital services.
8. Statutory defect rights and liability
Statutory defect rights apply to digital products. Device-dependent limits of speech input, transcription or text recognition do not restrict those rights where specific characteristics were agreed.
schukai is liable without limitation for intent and gross negligence, injury to life, body or health, and under mandatory product liability law. For a slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract. Mandatory statutory liability remains unaffected.
9. End of contract
Use can be ended by uninstalling. Users should first export content they need through the means available in the app. Files already stored outside the app or passed to other applications are not removed by uninstalling.
10. Law, dispute resolution and new versions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules at the user's habitual residence remain applicable. Statutory jurisdiction applies to consumers.
schukai is neither obliged nor willing to participate in proceedings before a consumer arbitration body unless required by law.
This version applies to contracts into which it is effectively incorporated. Publication of a later version does not automatically replace it. Changes to continuing contracts are made only through a legally permissible amendment procedure.
