Zeit licence terms

Deutsch

This contract version is intended for forthcoming app offers. It does not automatically change existing agreements. Additional offers apply only when actually offered and separately agreed.

Version 3.1.3 · Dated 5 November 2026

1. Parties and scope

The licensor is schukai, postal address: Eichenstraße 26, 82290 Landsberied, Germany, email: hey@schukai.com, with full provider and contact details in the imprint ("we"). These terms govern your use of the app "Zeit" as licensee. Purchase, payment and refunds through Google Play are also subject to the Google Play terms.

2. Licence

  • We grant you a simple, non-transferable, non-sublicensable right to use Zeit to record your own working time.
  • The licence is for exactly one natural person. You may use Zeit on several of your own devices linked to your Google account.
  • You may use Zeit privately and professionally, for example as an employee or self-employed person for your own hours.
  • You may not share, pass on, rent out or jointly use the licence or a device with Zeit with other people; record other people's working time with Zeit; or have an employer use Zeit to record its staff's hours. schukai Workspace Team is intended for teams and companies.

Statutory transfer rights, including exhaustion of distribution rights, remain unaffected. Lawful transfer of a program copy does not automatically transfer a separate account or an ongoing service contract.

3. Trial and full version

Zeit is free for 30 booking days. After that, a one-time purchase through Google Play permanently unlocks new bookings. Data already recorded remains readable and exportable without a purchase. While Zeit is connected to schukai Workspace Team, no purchase price applies; your employer's rules then apply as well.

Scope of the purchase. The one-time purchase permanently unlocks the features described at the time of that purchase. Larger new features or feature packages may later be offered as separate, optional one-time purchases. Purchased features remain unlocked without another purchase and are not subsequently converted into a subscription. Ongoing services are offered separately unless already included in the promised purchase scope.

We provide statutorily required bug fixes and security updates without an additional purchase price. Other statutory duties, including updates necessary to maintain conformity with the contract, remain unaffected. We envisage adaptations to new versions of the supported operating systems and smaller improvements, without promising a particular development, release or deadline. Whether and when such voluntary updates appear may also depend on approval by the relevant store. This does not relieve us of statutory duties or promises already made.

This applies to both new and existing purchases. The services and any broader promises applicable at the original purchase remain binding, including expressly promised future features or updates. This version does not restrict those promises retrospectively or automatically replace existing contractual terms.

4. Your responsibility

  • Zeit is a tool, not legal advice. Hints about breaks, maximum hours, rest periods and public holidays are based on general statutory rules of the chosen country. Zeit does not take collective agreements, works agreements or special rules, for example for young people, pregnant workers or particular industries, into account.
  • You are responsible for complying with the working-time law that applies to you, recording your hours correctly and completely, checking target time, public holidays and leave entitlement, and keeping records for as long as required for you.
  • Whether a report from Zeit is accepted as evidence is up to the recipient. The signature technically shows that a report has not been changed since it was created; it does not confirm that the hours are correct.
  • Without schukai Workspace Team, Zeit stores your data on your device only; there is no account and no tracking. You are responsible for regular backups. "Delete all data" and uninstalling remove the data permanently.
  • If you connect Zeit to schukai Workspace Team, Zeit sends your bookings, leave requests and a device name ("Zeit · device model") to your employer's schukai Workspace Team server and loads target time, balance, holidays and absences from it. Your employer is responsible for this data; its privacy notice applies. When you disconnect, Zeit deletes the session and the cache on the device.
  • If you record other people’s data contrary to section 2, you fulfil data protection duties within your own area of responsibility. This does not exclude any statutory responsibility of schukai.

5. Intellectual property

Zeit and its protected elements may not be copied, incorporated or adapted without authorisation. You may not reverse-engineer, decompile or disassemble the software or otherwise derive its source code unless the activity is permitted by law. Lawful activities, particularly under sections 69d and 69e of the German Copyright Act, remain permitted. Within the statutory limits, these include backup copies, observing, studying or testing the program and achieving interoperability.

You may not incorporate protected program code or protected parts of the documentation, user interface or file specifications without authorisation into replicas, substitutes or imitating products, or into competing or compatible software. This does not impose a general ban on independent development based on unprotected ideas, principles, functionality or formats. Lawful interoperability is not prohibited.

You may access, export, back up, share and reuse your own content and data, including with other programs. This does not promise additional technical export features or change third-party rights in that content. Statutory rights and any broader rights under applicable third-party or open-source licences remain unaffected.

Zeit contains third-party components, such as the JetBrains Mono typeface (SIL Open Font License 1.1) and Font Awesome Pro icons, which are subject to their own licences.

Additional licence limits and protection of the app

The licence covers only the acts necessary for the agreed intended use of the offer actually obtained. Without a separate agreement, it grants no sublicensing, rental, redistribution or independent exploitation rights in the app or its protected components. Statutory transfer rights and validly offered family sharing remain unaffected. Agreed device, household, organisation and team use is not restricted by these limits; it does not authorise further commercial distribution of the software.

In particular, you may not extract, copy, adapt, publish, distribute or incorporate protected source or object code, graphics, music, text, documentation or protected design elements into your own or third-party products without authorisation. This also applies to replicas, replacement products, libraries, template packages and competing offers insofar as protected components are taken. The app licence creates no entitlement to source-code delivery, development materials or independent use of trademarks or branding. Rights necessary for the agreed use and broader rights under applicable third-party and open-source licences remain unaffected.

Reverse engineering, decompilation, disassembly and other derivation of source code, and bypassing licence or access controls, are prohibited without authorisation. This does not prohibit the statutory acts identified below or other acts mandatorily permitted by law. Non-public information may not be obtained through unlawful access or used or disclosed without authorisation where it is a legally protected trade secret. These terms do not turn publicly observable features into trade secrets.

Users' own content and data do not become app components owned by schukai. Their intended use, promised backup, export and team features, and rights in third-party content remain available within their respective legal and contractual scope. These limits create neither exclusive rights in unprotected ideas, principles, procedures, functionality or formats nor a general prohibition on independent development.

Mandatory local exceptions

The following exceptions apply where the identified law governs the particular case. Statutory conditions and purpose limits must be met; an act permitted for interoperability does not generally authorise incorporation of protected code into an imitating product.

  • Germany/EU: Non-waivable rights to backup copies, observation, study and testing, interoperability and other mandatorily permitted uses remain unaffected, particularly under sections 69d and 69e read with section 69g of the German Copyright Act or the applicable national implementation. This includes relevant mandatory educational and preservation provisions. Lawful onward transfer following exhaustion is not excluded by a blanket transfer prohibition.
  • United Kingdom: Where the Copyright, Designs and Patents Act 1988 applies, acts that cannot be excluded under sections 50A, 50B and 50BA read with section 296A remain permitted.
  • Australia: Where the Copyright Act 1968 applies, acts protected by section 47H under subsection 47B(3) and sections 47C to 47F, including statutory backup, interoperability, error-correction and security-testing rights, are not excluded.
  • Other jurisdictions including the USA: Local rights that cannot effectively be excluded remain unaffected. These terms contain no blanket waiver of mandatory statutory use, consumer or legal-remedy rights. Naming particular countries does not restrict corresponding rights elsewhere.

These limits apply only to agreements into which this version has been effectively incorporated. Existing purchase promises and contractual rights are not reduced retrospectively. No additional fees, device-inspection powers, contractual penalties or blanket entitlement to user data are agreed.

6. Warranty

Statutory defect rights and limitation rules apply. Statutory consumer rights for digital products remain unchanged. Even for business purchases, the required characteristics are not excluded by a blanket supply “in its current state”, and no general one-year limitation period is agreed.

7. Liability

schukai is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, within the scope of a guarantee given, and under the German Product Liability Act and other mandatory liability rules.

For a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract at the time it was concluded. Essential obligations are those whose fulfilment makes proper performance of the contract possible and on which you may regularly rely. Otherwise liability for slight negligence is excluded.

These limitations do not apply in the cases described in the first paragraph. This liability clause does not restrict statutory rights to cure defects, reduce the price or end the contract.

If you culpably contributed to the occurrence or extent of damage, that contribution is assessed under the applicable statutory rules. This also applies to omitted backups where making them fell within your responsibility and was possible and reasonable. Backup and recovery services owed by schukai remain unaffected.

The exclusions and limitations apply to the same extent in favour of schukai's legal representatives, employees and persons used to perform its obligations.

8. Term and termination

A paid perpetual licence is unlimited in time. A pause in use, uninstallation or a change of device does not extinguish it. Restoration on a supported device of your own follows the agreed distribution channel and personal licence in section 2. This does not promise indefinite store operation or support for every device.

Termination by schukai for breach requires good cause and a corresponding notice. For a remediable breach, you first receive a reasonable opportunity to remedy or a warning unless the law makes this unnecessary. Statutory rights and the consequences of a justified reversal of the purchase remain unaffected.

9. Changes

Publication of a new version does not automatically replace existing contractual terms. Changes require a legally permissible amendment procedure; consent is not inferred merely from continued use. Purchased rights and broader promises remain available. Statutorily required updates are not made conditional on acceptance of additional unrelated terms.

10. Law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where Article 120 of the Swiss Private International Law Act excludes a choice of law for a consumer contract, the law determined by that provision applies instead; the German choice of law does not apply to that extent. Consumers retain mandatory protection of their habitual country of residence and statutory jurisdiction applies. A jurisdiction agreement with merchants designates the courts competent for schukai’s registered seat in Freising only insofar as applicable national or international law, including its formal requirements, permits this. Mandatory jurisdiction remains unaffected.
