Version 1.0.2 · Dated 1 November 2026
1. Provider and scope
PickQueue is provided by schukai, Eichenstraße 26, 82290 Landsberied, Germany; email: hey@schukai.com. Full contracting-party details are in the legal notice.
These terms cover the Android app with package ID com.schukai.pickqueue, its associated web app and the optional PickQueue Sync service. Personal data processing is covered separately by the PickQueue privacy notice.
2. Contract formation and minimum age
Free local use is offered when PickQueue is supplied through a distribution channel designated by schukai and these terms are available before supply. A PickQueue Sync contract is formed only when the user expressly orders a monthly or annual subscription through Google Play and Google Play confirms its conclusion.
PickQueue is intended for people aged 18 or older. Anyone setting it up for a household or subscribing to PickQueue Sync must be at least 18. Google Play terms additionally govern the store, payment and subscription managed there. Statutory claims against schukai remain unaffected.
3. Local use
Local lists, items, stocks, photos and settings are processed on the device. Neither a schukai account nor PickQueue Sync is required. The app can be used offline; individual operating-system, camera, store or device functions may require a connection or permission.
Users are responsible for local data. PickQueue provides export and restore mechanisms insofar as available in the version used. Exported files must then be protected and backed up at the chosen storage location.
4. PickQueue Sync
PickQueue Sync transfers shared list events with end-to-end encryption. List names, items, quantities, notes and synchronised images are encrypted on the device before transfer. The relay receives no list keys and cannot decrypt this content.
One subscription covers one paired household, including up to 10 synchronised lists, 10 active accesses per list and 100,000,000 bytes of encrypted Sync data. These limits protect shared operation. A local list is not blocked or deleted when a limit is reached or Sync access ends.
Synchronisation requires a suitable internet connection, a supported app version and valid access secrets. Short interruptions, delayed delivery and later synchronisation after reconnection are part of distributed offline operation. Uninterrupted availability is not promised.
5. Right of use
schukai grants the user a non-exclusive, non-transferable right to use PickQueue for its intended private household purpose for the contract term. This includes sharing lists and pairing household devices through the intended app procedure.
Unauthorised rental, transfer and circumvention of protection or access controls are prohibited. Statutory rights, including exhaustion, backups, error correction and interoperability, remain unaffected. Lawful transfer of a program copy does not automatically transfer an account or Sync subscription. Independent development based on unprotected ideas or functions is not prohibited.
6. Lists, sharing and keys
Users decide what content to record and with whom to share a list. They must not transfer unlawful content or infringe third-party rights. Sharing credentials and recovery data must be treated as confidential access credentials.
schukai cannot recover lost list keys, household secrets or local data. If the last authorised access is lost and no suitable recovery export exists, encrypted data may remain permanently inaccessible. An available recovery procedure should therefore be checked before changing devices or uninstalling.
7. Price, renewal, termination and withdrawal
PickQueue Sync is subject to the prices including taxes displayed in Google Play before purchase and the selected initial term of one month or one year.
The initial term displayed in the purchase offer ends at its expiry if cancelled in time; you may give ordinary notice at any time before then. Without cancellation, the subscription continues for an indefinite period after the initial term. You may then cancel at any time with no more than one month's notice. Shorter periods granted by the offer or law remain available. Annual billing does not create another fixed annual commitment.
You can manage and cancel the subscription in your Google Play account. You may also send necessary termination notices and other statutory declarations to hey@schukai.com. Your rights do not depend on whether the store interface offers a particular function. Sync access ends when termination takes effect; advance fees for periods after that date are refunded proportionately. Statutory withdrawal, refund and termination rights remain unaffected.
For consumers habitually resident in Austria, the following also applies: before the initial term moves into indefinite continuation without cancellation, we separately remind you at the start of a reasonable declaration period about continuation, its effects and the cancellation option. Without the required reminder, continuation based on silence does not take effect. Broader mandatory rights of your country of residence remain available.
Ending Sync does not affect local use or your local data. Store terms do not restrict statutory rights against schukai.
8. Updates and changes
schukai provides statutorily required updates, including security updates, and gives information through the designated distribution channel or in the app. No additional fixed voluntary support or update period is agreed.
Valid reasons for changes to ongoing digital services are changed operating-system or store requirements, security risks, mandatory legal changes or the loss of irreplaceable third-party components.
Changes to an ongoing digital service beyond maintaining conformity are made only for one of the stated valid reasons and without additional cost. We provide clear information about the change. If access or use is adversely affected more than insignificantly, we give reasonable advance notice on a durable medium explaining the content, timing and your statutory rights. Where the statutory conditions are met, you may terminate free of charge within 30 days. The period starts on receipt of the information or, if later, when the change occurs. Statutory exceptions, including continued unchanged use at no additional cost, remain applicable. This does not authorise changes to agreed prices or withdrawal of purchased perpetual rights.
9. Statutory defect rights and liability
Statutory defect rights apply to digital products. References to device, operating-system or connection dependencies do not restrict those rights.
schukai is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, within the scope of a guarantee given, and under the German Product Liability Act and other mandatory liability rules.
For a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract at the time it was concluded. Essential obligations are those whose fulfilment makes proper performance of the contract possible and on which the user may regularly rely. Otherwise liability for slight negligence is excluded.
These limitations do not apply in the cases described in the first paragraph. This liability clause does not restrict statutory rights to cure defects, reduce the price or end the contract.
If the user culpably contributed to the occurrence or extent of damage, that contribution is assessed under the applicable statutory rules. This also applies to omitted backups where making them fell within the user's responsibility and was possible and reasonable. Backup and recovery services owed by schukai remain unaffected.
The exclusions and limitations apply to the same extent in favour of schukai's legal representatives, employees and persons used to perform its obligations.
10. End of contract and data
Free use can be ended by uninstalling. Local data remain after PickQueue Sync ends. Existing encrypted relay data may be read-only during a limited recovery phase after Sync effectively ends and are then deleted under the periods described in the privacy notice.
Before the contract ends, users may export local data and any offered recovery files. schukai does not owe decryption without the keys held on authorised devices or in a recovery export.
11. Law, dispute resolution and new versions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where Article 120 of the Swiss Private International Law Act excludes a choice of law for a consumer contract, the law determined by that provision applies instead; the German choice of law does not apply to that extent. Mandatory consumer protection rules of the user's habitual country of residence remain applicable. Statutory jurisdiction applies to consumers.
schukai is neither obliged nor willing to participate in proceedings before a consumer arbitration body unless required by law.
This version applies to contracts into which it is effectively incorporated. Publication of a later version does not automatically replace existing terms. Continuing contracts are amended only through a legally permissible procedure.
