Stewfolk Wimmelbild / Stewfolk Hidden Objects — Terms of use and licence (EULA), 0.1.1

Deutsch

This contract version is intended for forthcoming app offers. It does not automatically change existing agreements. Additional offers apply only when actually offered and separately agreed.

1. Provider and scope

The provider is schukai, Eichenstraße 26, 82290 Landsberied, Germany; email: hey@schukai.com. Full details of the contracting party are available in the legal notice.

These terms concern the Android app described below, distributed through Google Play. The specific pre-contractual description and effective individual promises remain binding. The contract is concluded through the applicable offer and ordering process; these terms apply only if effectively incorporated. A link or a new website version alone does not change an existing agreement. The privacy notice provided for the app and its version applies separately to personal-data processing; these terms do not replace required consent.

2. Offer and business model

Stewfolk Hidden Objects, named Stewfolk Wimmelbild in the German offer, is a separate paid Android game through Google Play. It is offered to people aged 18 or over. The one-time download purchase includes all game content offered for the acquired edition, unlocked from the outset. The actual store price is displayed before purchase.

The game works offline without a game account. This edition contains no in-app purchases, subscriptions or server services operated for the game. Its purchase does not buy the separate game Stewfolk or automatically grant rights to other app packages. Statutory transfer rights and family sharing validly granted through Google Play remain unaffected.

Game progress is stored locally. Cloud synchronisation or restoration of local game progress by schukai is not included. This does not restrict statutory claims for data loss for which schukai is responsible.

3. Right of use

schukai grants a non-exclusive right to use the lawfully obtained app for your own purposes, within the acquired scope, on authorised devices. For games this covers your own private play; for work and communication tools it also covers your own professional use or intended use by authorised organisation members. Professional use does not automatically make a contract a business-to-business agreement. A local licence acquired without a time limit is not made temporary merely by later new offers.

The app and protected content may not be copied, distributed, rented or used to bypass others' access rights without authorisation. Lawful transfer, statutory rights and valid store family-sharing rights remain unaffected. Statutorily permitted backup copies, observation and testing of the program and decompilation for interoperability remain allowed, particularly within sections 69d and 69e of the German Copyright Act. Independent development based on unprotected ideas, functionality or formats is not generally prohibited. Broader rights under third-party and open-source licences remain applicable to their components.

Your content remains attributable to its respective rights holders. This licence does not transfer general exploitation rights in your content to schukai. You may lawfully back it up, reuse it and process it with other programs, respecting third-party rights; this does not promise additional technical export features.

Additional licence limits and protection of the app

The licence covers only the acts necessary for the agreed intended use of the offer actually obtained. Without a separate agreement, it grants no sublicensing, rental, redistribution or independent exploitation rights in the app or its protected components. Statutory transfer rights and validly offered family sharing remain unaffected. Agreed device, household, organisation and team use is not restricted by these limits; it does not authorise further commercial distribution of the software.

In particular, you may not extract, copy, adapt, publish, distribute or incorporate protected source or object code, graphics, music, text, documentation or protected design elements into your own or third-party products without authorisation. This also applies to replicas, replacement products, libraries, template packages and competing offers insofar as protected components are taken. The app licence creates no entitlement to source-code delivery, development materials or independent use of trademarks or branding. Rights necessary for the agreed use and broader rights under applicable third-party and open-source licences remain unaffected.

Reverse engineering, decompilation, disassembly and other derivation of source code, and bypassing licence or access controls, are prohibited without authorisation. This does not prohibit the statutory acts identified below or other acts mandatorily permitted by law. Non-public information may not be obtained through unlawful access or used or disclosed without authorisation where it is a legally protected trade secret. These terms do not turn publicly observable features into trade secrets.

Users' own content and data do not become app components owned by schukai. Their intended use, promised backup, export and team features, and rights in third-party content remain available within their respective legal and contractual scope. These limits create neither exclusive rights in unprotected ideas, principles, procedures, functionality or formats nor a general prohibition on independent development.

Mandatory local exceptions

The following exceptions apply where the identified law governs the particular case. Statutory conditions and purpose limits must be met; an act permitted for interoperability does not generally authorise incorporation of protected code into an imitating product.

  • Germany/EU: Non-waivable rights to backup copies, observation, study and testing, interoperability and other mandatorily permitted uses remain unaffected, particularly under sections 69d and 69e read with section 69g of the German Copyright Act or the applicable national implementation. This includes relevant mandatory educational and preservation provisions. Lawful onward transfer following exhaustion is not excluded by a blanket transfer prohibition.
  • United Kingdom: Where the Copyright, Designs and Patents Act 1988 applies, acts that cannot be excluded under sections 50A, 50B and 50BA read with section 296A remain permitted.
  • Australia: Where the Copyright Act 1968 applies, acts protected by section 47H under subsection 47B(3) and sections 47C to 47F, including statutory backup, interoperability, error-correction and security-testing rights, are not excluded.
  • Other jurisdictions including the USA: Local rights that cannot effectively be excluded remain unaffected. These terms contain no blanket waiver of mandatory statutory use, consumer or legal-remedy rights. Naming particular countries does not restrict corresponding rights elsewhere.

These limits apply only to agreements into which this version has been effectively incorporated. Existing purchase promises and contractual rights are not reduced retrospectively. No additional fees, device-inspection powers, contractual penalties or blanket entitlement to user data are agreed.

4. Purchases, additional offers and ongoing services

A paid download, unlock or additional service requires a specific corresponding offer and an express order. The price including applicable taxes, scope and any duration displayed before ordering apply. Mentioning possible future purchases triggers no payment. Previously acquired features are not made chargeable again or converted into a subscription merely because of a new business model. Broader original promises remain binding.

For a purchase processed through Google Play, the corresponding platform terms govern the store account, payment and management and refund procedures offered there. The contractual and billing roles identified in the specific checkout and receipt are decisive; this EULA does not universally designate Google as seller of every service. Statutory claims against schukai remain unaffected.

A separately offered ongoing service must state, before ordering, in particular its price, billing period, minimum duration, renewal and cancellation. Cancellation ends future services and payments under the effective agreement; reimbursement is assessed separately. Mandatory cancellation and renewal rules remain applicable. A store account or organisation sign-in alone does not order an additional service.

5. Withdrawal, statutory remedies and updates

Statutory consumer rights, including withdrawal, refunds, remedies and price reduction, remain unaffected. A right of withdrawal does not expire solely through these terms, a download or use. Different legal conditions apply to digital content and services; required information, express consents and confirmations must be provided separately in the relevant process.

schukai provides legally required fixes and updates, including security updates, without an additional purchase price and gives information through the designated delivery channel. Statutory conformity duties and broader promised services remain binding. Unlimited support for every future device or operating system, or a particular release date for voluntary expansions, is not agreed without a specific promise.

Changes to digital products supplied on an ongoing basis are possible only within the legally permitted and effectively agreed framework. Required advance information, maintenance of conformity and statutory termination rights remain protected. A new text version does not replace an effective legal basis for a change.

6. Data, devices and third-party services

The device and system requirements described for the offered edition apply to its stated features. Your own necessary internet or mobile charges are not an additional licence fee charged by schukai. Third-party services have their own agreements; an app licence does not grant access rights to them.

Use available backup and export options for important local data. Deleting app data, uninstalling or losing a device may remove local data. This creates neither an entitlement to remote recovery that is not offered nor an exclusion of schukai's responsibility for its own breaches. Purchased rights and locally stored data must be considered separately.

7. Liability

schukai has unlimited liability for intent and gross negligence, injury to life, body or health, and under mandatory product liability law. For a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable loss typical of the contract. Mandatory statutory liability and mandatory consumer rights remain unaffected.

8. Ending use and changes to agreements

You may end local use by uninstalling the app. This does not automatically cancel a separate ongoing service; use its specified cancellation channel. Uninstalling also does not delete a store purchase receipt. Termination for good cause remains subject to statutory conditions, including any required opportunity to remedy a breach or warning. schukai has no unrestricted right to remove a paid permanent licence without an effective reason.

A new website or app version does not automatically change earlier contracts. New terms require an effective legal basis. Previously promised services and mandatory rights remain binding.

9. Law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection at the user's habitual residence and other mandatorily applicable law remain unaffected. Statutory courts have jurisdiction for consumers. No language version overrides mandatory language or consumer rights; legally required interpretation in favour of consumers remains protected.

schukai is neither obliged nor willing to participate in proceedings before a consumer arbitration body unless a statutory obligation applies. For app questions and claims, contact hey@schukai.com.
